Ein neuer Abmahnverein namens Online-Fair-Trade e.V. mahnt derzeit vermehrt Amazon-Händler ab. Angeblich sollen die Händler eine falsche Widerrufsbelehrung verwendet haben. Uns liegen mittlerweile einige Abmahnungen vor, so dass der Anschein erweckt wird, als ob es sich um eine gezielte Abmahnwelle handelt. Ob der Verein tatsächlich abmahnberechtig ist, kann zum jetzigen Zeitpunkt noch nicht abschließend beurteilt werden. Es gibt jedoch verschiedene Ansatzpunkte, die gegen eine Berechtigung sprechen. Trotzdem sind Händler natürlich verpflichtet, ein ordnungsgemäßes Impressum und eine ordnungsgemäße Widerrufsbelehrung zu verwenden.
Diese Prüfung sollte - um künftige Abmahnungen zu vermeiden - in jedem Fall parallel zur Erwiderung auf die nun erfolgte Abmahnung erfolgen. (…)
