NH AG Kelly Ayotte and NH HHS should face class action lawsuit for all unlawful searches of DNA evidence on juveniles.

By Christopher King

ADVERTISEMENTS
Dear Attorney Ayotte and NH HHS:

You and NH HHS unlawfully seized hundreds of juvenile DNA samples per RSA 651-C over the past several years. I've got judicial orders noting that DNA testing could not be compelled against non-violent juvenile offenders, but the State of New Hampshire has been doing it for at least four (4) years. Judge David LeFrancois rocked your World on that in September 2007.

And NH ACLU director Claire Ebel reportedly told you that your position on the law was untenable. Yet and still your office and HHS kept on, prosecuting people for contempt on it, as if you were stuck on stupid. It's a crying shame, really.

So then: Please provide me a copy of any and all form letters sent to juveniles, their parents or counsel compelling said juveniles to issue DNA samples per RSA 651-C. You know the bill, it's the one that Kelly cried about in the Union Leader when the legislature didn't expand to include nonviolent juveniles, and they tried to slide them in at the last minute. Yah, those form letters. NH blogger Jonathan Melle has a bit on this in his "On Politics" blog, including a copy of Kelly crying, and I'll have more to come.
