UL shows Dalton Police Chief and HB 1428 Bruce McKay highway sponsor John Tholl good on DUI, but still negligent on police abuse of Diane Lyon.

Dear Chief Tholl:

Thank you for your get tough stance on DUI, as noted in today?s paper. That sets a Good Tone for irresponsible LE like NH AG Kelly Ayotte, who has not punished Hooksett?s Benjamin Beauchemin, who was clearly acting inappropriately after drinking when he rolled his car. She let him and other maliciously irresponsible LE off the hook even when they violated Miranda by impersonating officers from her own office in the Michael Paulhus case; take a look.

Tholl was so outraged by the Beauchemin incident, he said, he initiated plans to rein in the process of appealing the 180-day license suspensions for people arrested for DWI who either refuse a breath test or register a blood-alcohol concentration at or above the legal limit of .08 for adults. The proposed change basically would allow a police department to send another representative if the arresting officer isn't available to appear at the appeal hearing, Tholl said.

Beauchemin, 26, refused a breath test after rolling his Jeep Liberty May 11 in Auburn in an off-duty crash.

He appealed the 180-day pre-trial administrative license suspension and kept his driving privileges because the arresting state trooper failed to appear at the hearing due to a scheduling conflict.

However, what are you doing about Diane Lyon's case, where your officer smacked her up, tossed her around a bit and arrested her without Probable Cause? And he keeps harassing Diane and her family, it is well-documented. That?s a picture of her arm she sent me. We?re going to get her a duly-licensed attorney, Sir but in the meantime can you get your officer to quit creeping on her and her family? It?s patently Unconstitutional and it doesn?t speak well to your level of integrity.
