This order memorializes Judge Davis' rulings from the pretrial conference. At that time he denied the defendant's motion for summary judgment as to MathWorks's copyright infringement claim and breach of the EPA claim, but granted its motion for summary judgment as to MathWorks's misappropriation claim because Massachusetts law applies, and MathWorks could not overcome the "news information piracy" limitation of this claim.
