Immigration Law
Monday, February 23, 2009
By Angelo A. Paparelli and Ted J. Chiappari

"Angelo A. Paparelli, a partner in Seyfarth Shaw, and Ted J. Chiappari, a partner at Satterlee Stephens Burke & Burke, write that despite the loss of millions of jobs, the global destruction of asset values and plummeting consumer confidence, America's rickety economy still boasts full employment in at least one thriving industry sector. The 100 senators and 435 House members of the U.S. Congress, they say, continue to produce meaty, tummy-busting legislation."

Employee Benefits
Monday, February 23, 2009
By Donald P. Carleen

" Donald P. Carleen, a partner at Fried, Frank, Harris, Shriver & Jacobson, analyzes a recent U.S. Supreme Court decision that held that a waiver of benefits is not an 'alienation' of benefits prohibited by the antialienation provisions of ERISA. However, he notes, the Court also held that such a waiver need not be respected by a plan where plan documents provide a specific method for designating beneficiaries that has not been followed."

Circuit Gives Guidance to Litigators On Securities Fraud Claims
Monday, February 23, 2009
By Douglas I. Koff and Jason Jurgens

"Douglas I. Koff, a member of Cadwalader, Wickersham & Taft, and Jason Jurgens, special counsel at the firm, write that, historically, courts have been hostile to theories that seek to blur the distinction between scienter and materiality, and typically emphasize that only the materiality of the alleged untrue statement of fact is relevant - not the materiality of the act or transaction that caused the untruth to be published. In any event, they conclude, it remains to be seen how practitioners and courts will construe the Second Circuit's rationale in JPMorgan regarding the 'market reaction' SAB 99 factor."

SPECIAL REPORTS:

New York Law Journal Magazine
Monday, February 23, 2009
"The talk about advancing women at law firms follows two general paths: What women can do to advance themselves and what firms can do to change the traditional ways of conducting business. This Women in the Law issue of the New York Law Journal Magazine reveals progress on both fronts, but there is still much work to do."

Also, in the highlighted article from this section,

Free With Registration: Full-Time Leadership
"The legal profession may no longer be an exclusive boys club but the majority of players at the high-stakes tables are still men. The nature of the game is changing, however, as a new generation of lawyers waits to be dealt in. But whatever generational shift may ultimately cause law firms to re-examine their entire business model, it will be prompted by the changes implemented today by firms seeking to stop the exodus of female attorneys.
