Matter of Ronga v. Klein, ___Misc. 3d___(N.Y. Co. March 19, 2009), demonstrates a fundamental principal of Education Law. Tenure by estoppel can only occur if the employee teaches after his or her probationary period expires. Here, a Principal was removed June 30th and was reassigned July 1st.

As June 30th was the last day of his probationary period he did not acquire tenure by estoppel. This case also demonstrates that school principals, like teachers, are entitled to the protections afforded by Education Law Section 3020-a.
