Baby boomers cap damages with made in China cheer

By Steve Lombardi

ADVERTISEMENTS

I want to start out this blog with a song by Quynh Anh. She has a great voice but the message she sings is most appropriate for today's baby boomers. You should listen to it as you read today's blog, which is like a protest. I'll say this about the generation born after the mid 1970's, at least they have an excuse for not knowing what we stood for in the 1960's and 70's. Baby boomers have no acceptable excuses. We have forgotten who we are; we are no longer us, because we are now the establishment.

(The Quynh Anh web site version of Bonjour Vietnam is of better quality than YouTubes.)

Getting capped is an old term used by gangsters for taking someone out. The U.S. corporations have been lobbying America and shaping it into acting like a communist mob system of governance that takes away the rights of people while they rape and pillage the financial markets and take bonuses for doing nothing more than showing up. (Participation Trophy's) The idea of putting caps on what they call non-economic damages is simply a way of shifting the costs of professional mistakes and shoddy products to patients and consumers while corporate America amasses greater financial wealth. It's nothing more than a reverse Robin Hood by a bunch of aging gutless hippies.

American business and politicians are taking a page from the lesson book the Chinese Communist Party employs to control awarding civil damages in cases governed by Chinese tort law. Simply put the CCP takes the licenses from those lawyers whose law practices represent people with physical injuries; they simply disbar them. Yes, you read that right. Disbarred.

Patients, consumers and voters should take heed, because your lives can be just as miserable as the average Chinese citizen's. Mothers, do you know what the CCP did to Chinese lawyers representing Chinese babies poisoned with melamine in infant formula. To those with a history of civil rights being trampled on by those in power, do you know what they do to lawyers representing protesters in China? Do you have a clue what the CCP is doing to lawyers representing the parents of children crushed in the collapse of shoddy school buildings? And to the lawyers taking on the representation of the protesting Tibetan monks, they got the same thing. In each case it is the same, disbarment.

IS THE CRITICISM OF CHINA BY THE U.S. THE POT CALLING THE KETTLE BLACK?

Like the Madoff scandal in American, just a few individuals and no government officials have been prosecuted in China for the melamine tainted infant formula crisis. I thought we were the ones with the highly developed court system. Seems to me we have similar results.

Why haven't Chinese government officials been prosecuted for the melamine scandal?

Why haven't U.S. government officials and others been indicted in the $50 Billion Madoff Ponzi Scheme? Don't criticize China when we aren't doing any better.

Are the CCP's tools of choice to control citizen protesters much different than American law enforcement? Certainly, because as we like to think, America is a free country!

Remember 'Don't taser me bro!'? The CCP used the same tactic in Tibet against monk protesters. Still today I can't figure out what this kid did that required an arrest and tasering. Was he not allowed to speak at a political rally? Or was it what he said that deserved punishment? Sort of like Tibetan monks getting beaten for speaking their minds.

Certainly U.S. police don't overreact with the use of force in numbers against someone who uses words to protest; American police are better trained, and more intelligent, aren't they? And certainly the U.S. Constitution protects citizens against abuse of police power; doesn't it?

Keep passing costs of mistakes to patients and consumers and soon the business community will be no better than the Chinese Communist Party and its treatment of infants with kidney failure from tainted baby formula. It's all about money and who gets to keep the most. We've certainly been here before although I doubt many baby boomers have the inclination or functioning brain cells to remember to what I'm referring. And our children are too young to know what happened at Kent State on May 4, 1972. Do you?

What's wrong with Americans? We see hundreds of CEO's of public corporations take unearned bonuses amounting to billions and billions of dollars and we go about our daily business as if nothing were even slightly wrong. We criticize this next generation as the entitlement generation; and I'm as guilty as the rest on that one. In comparison severely injured people earn a jury verdict in a civil court and the majority throws the few that squeak through, under the bus either awarding no one significant damages or they pressure Congress to cap those damages that allow for a quality of life. The baby boomers have become their parents. They have become the establishment we despised and marched in protest against. The baby boomers have a new high; it's called money, self indulgences and denial.

We pick on the poor, the helpless, the aged, the unrepresented, the under represented and the powerless. We are what who we protested against. We have money though and that makes us feel secure. We are the new organized criminal enterprise; the money mob that sanctions organized corporate criminal activity through shareholder voting.

In the end money isn't security. You should have learned that after the Y2K fraud practiced on those who invested in Internet stocks. If you need a refresher course in the new organized criminal enterprises, compare your 401K plan from 12 months ago.

As some of you know I like the mountains. On the trek to base camp several years ago, a Buddhist said to me 'You Americans have everything and yet you have nothing.' He was right, about more than he knew. I'll blog on that another day, but for now you can get back to your baby boomer wine and cheese while you sit and toast your Made in China cheer.
