International Banking " Kathleen A. Scott, counsel at Arnold & Porter, discusses the the system-wide approaches the U.S. and the EU have taken in implementing the G-20 mandate to 'implement reforms to strengthen financial markets and regulatory regimes so as to avoid future crises.' While it is understandable that the U.S. and the EU would want to attempt to institute a process for monitoring systemic risk, the proposed Financial Services Oversight Council and European Systemic Risk Council are just that, advisory monitors. Tax Appeals Tribunal "Joseph Lipari and Debra Herman, members of Roberts & Holland, write: On May 20, 2009, Tom Golisano wrote a column for the New York Post which has received widespread publicity. As tax lawyers who have significant experience in New York State Personal Income Tax residency litigation, we were primarily struck by a relatively brief passage in the column, where Mr. Golisano wrote that with a few simple actions - registering to vote, changing his license, etc. - he became a resident of Florida and a non-resident of New York, saving millions in taxes. We have no way of knowing Mr. Golisano's personal tax situation, but we can say without hesitation that anyone who follows his advice on changing one's residence will almost certainly find that upon audit, he remains a New York resident and will owe the New York taxes purportedly saved together with interest and possibly penalties."

REAL ESTATE TRENDS:
Free With Registration: Financing "Jeffrey B. Steiner and Jason R. Goldstein, members of DLA Piper, write that zombie loans have dominated recent discussions in both real estate finance industry journals and conferences alike. The term, they say, refers to mortgage loans that while generally considered performing, since the property cash flow or other reserves cover the cost of operating the property and the payment of debt service, are in fact destined for default at a foreseeable later date when, at maturity, the debt service reserve runs dry or the property owner will be unable to refinance the impending balloon payment due to tightening credit standards and depressed real estate values."
