: New York City Personal Injury LawyerDirty Conditions and Undisclosed Allergens Found in Dietary Supplement and Protein Powder Companies
By Oguz Ozdemir
The Food and Drug Administration (FDA) called in the U.S. Department of Justice to file a permanent injunction against three companies and the man who oversees all of these operations. The companies in question are American Sports Nutrition, Inc., Quality Formulation Laboratories, Inc., and Sports Nutrition International LLC. The person who is head of operations at all of these manufacturing plants, Mohamed S. Desoky has also been cited.
All three companies are located in Patterson, New Jersey and produce protein powders and dietary supplements. The problems with the companies stem from filthy conditions that have been investigated on several occasions and have never been corrected and undisclosed allergens in the supplements and protein powders.
The conditions at the manufacturing plants failed to follow what is known as Good Manufacturing Practice or GMP. On the contrary, FDA inspections showed live and dead rodents, rodent urine, feces and holes in the packaged products that were the result of rodents gnawing on them.
In addition, they did not clean the processing equipment after each batch was produced and they had included major food allergens in the products and failed to disclose this information on the labels. Anyone who used any of these products and was allergic to milk or milk products was put in jeopardy.
The products were manufactured and marketed under the company name as well as for private label companies. After three inspections, the Department of Justice filed a complaint for a permanent injunction against all three companies and Mr. Desoky on July 10, 2009.
The filthy conditions in itself made for a health risk with all three inspections by the FDA showing rodent problems that were never addressed or corrected in any way. The improper production of the products on equipment that was not kept up to the required level of cleanliness and hygiene further jeopardized the safety of anyone who purchased products from these companies or inadvertently through private labels.
Besides the lack of sanitary conditions, the addition of food allergens without disclosing them on labels puts innocent people at risk. Many people suffer from allergies to milk and milk products so including them in their dietary supplements and protein powders has put those people in a harmful position.
The companies under the direction of Mohamed Doesky were warned over and over but still ignored the violations and continued producing their products in filth and without revising their labels. These were not FDA approved products but rather over-the-counter supplements and available to an even wider market of people in the general public.
If you or someone that you know purchased any of these supplements or protein powders from any of the above named companies and were put at risk and or suffered any consequences as a result of this negligence, contact our attorneys at Napoli Bern Ripka so we can discuss a plan of action.
The public should not have to be put at risk when purchasing products from what they assume to be reputable companies. But processing products under filthy conditions and including ingredients without fully disclosing them for the consumer is a definite sign of negligence.
