What Makes a Good Malpractice Case?

By Oguz Ozdemir

ADVERTISEMENTS

You may never have envisioned yourself in this position but you have become the victim of a doctor's negligence. You have heard talk about medical malpractice law suits but you don't know the first thing about it. What would make a good malpractice lawsuit?

First you should contact a lawyer who has some experience in medical malpractice cases. You can get a free consultation and an attorney who is well verse in medical malpractice will take in all of your facts and information and evaluate your case. Because malpractice law suits take a lot of time and money, an attorney has to determine up front if he or she thinks that you are going to realize enough of a settlement to give you the compensation that you are looking for and cover legal fees and expenses.

An attorney must be able to prove that the negligent actions of a doctor or health care professional were below the normal standards of operation for a physician in his or her class. This usually takes interviews with other doctors and is time consuming and very detailed and specific.

If it can be proved that there was negligence it must be proved that the patient suffered as a result of these actions. Most of the actions that constitute a medical malpractice law suite are misdiagnosis, delayed diagnosis or incorrect diagnosis. It could also be due to complications from surgical procedures gone wrong.

Once it has been established that negligence did occur, and did suffer as a result, it must be determined if the patient would have still suffered if a diagnosis had occurred sooner. Determining the what ifs in a medical malpractice law suit not only are the deciding factor as to whether the attorney will take the case it also determines the amount of damages that would be appropriate.

But it is hard to gauge whether someone who may have had preexisting conditions was going to contract a disease whether or not the physician had diagnosed the patient on time or properly. There are so many elements involved that only a professional attorney who is familiar with malpractice cases and has seen them in action can gauge the outcome and choose to take the case or not.

Medical malpractice encompasses just about every type of doctor, such as dentists, chiropractors, eye doctors - anyone who treats you for an illness or ailment and their negligent actions cause you serious harm or injury. If you have experienced any side effects or injuries or life threatening side effects as a result of physicians negligence you should contact an attorney at once.

Our attorneys at Napoli Bern Ripka have years of medical malpractice experience. They would be happy to go over all of the aspects of the case and provide you with a comprehensive evaluation. Give us a call at 1-888-LAW-IN-NY today.
