Misusing one?s official position to gain a personal advantage
New York City Department of Corrections v Rodriguez, OATH Index #792/09

The Administrate Law Judge found that Kathleen Rodriguez, a New York City correction officer, guilty of using her official position and title in an effort to intercede in a criminal prosecution on behalf of a personal friend and that Rodriguez attempted to use her position to gain access to unauthorized access to confidential court files.

ALJ Faye Lewis also concluded that Rodriguez violated the City's Conflict of Interest Law by using her position as a public servant to obtain personal advantage and by engaging in a business transaction in conflict with the proper discharge of her duties.

The recommended penalty: suspension without pay for 60 days.

The decision is posted on the Internet at:http://archive.citylaw.org/oath/09_Cases/09-792.pdf
