The following is a purported communication from Judge Robert Carney, posted under "Off the Chain!" at 10:29 this morning:    "While I don?t ordinarily contribute to this blog, I feel it might be appropriate to set some facts straight. Mr. Finkelstein was not involved in the trial or appellate practice in any of the cases he now expounds on, and he has made some factual errors. First, I have been linked to Frank Lee Smith. I was not the assigned prosecutor on that case and did not try it. The trial attorney was Bill Dimitrouleas. While I tried Christopher Clugston twice against Ray Sandstrom, both resulted in a hung jury. The case was then given on an executive assignment to Miami Dade. Sam Rabin, now in private practice, tried that case to a conviction...continue to full post
