Section 292 (False marking): PATracer reports on a district court decision in favor of Target — holding that the retailer is not liable for false marking even if it knowinly sold products that were falsely marked. [LINK]- Divided Infringement: PATracer also reports on an interesting non-infringement decision in favor of DirecTV based on the company's outsourcing of customer support operations. 'DirecTV can not be liable for direct infringement of an asserted claim if the evidence demonstrates that DirecTV neither performs by itself nor directs nor controls a third party's performance of any one element of the claim.'
