: Legal Pad | LAClass-action suit says Nutri-Grain bars not so Nutri
By Richard Binder
A class-action law suit filed Monday in San Diego accuses Kellogg's of false advertising, claiming that the company's Nutri-Grain bars actually contain trans-fats.
In their ads, Kellogg's suggests that Nutri-Grain bars allow you to "Eat Better All Day" because they contain calcium and whole-grains, but the plaintiffs insist that those claims are invalidated by the presence of trans-fats, which contribute to diabetes and heart disease.
The plaintiffs are seeking compensatory damages and demand that Kellogg's mount a "corrective advertising campaign." Kellogg's is being sued for violations of he Lanham Act, Unfair Competition Law, Common law of Unfair Competition, False Advertising Law, and the Consumer Legal Remedies Act.
Full story here. Consumer Affairs is sympathetic but not entirely convinced.
