CO High Court: Finance Law Unconstitutional

By Peter Hardin

ADVERTISEMENTS

The Colorado Supreme Court has found certain state campaign finance laws unconstitutional under the U.S. Supreme Court’s recent Citizens United decision.

Gov. Bill Ritter had asked the state Supreme Court for a ruling clarifying state laws in the wake of Citizens United, which lifted restrictions on corporations spending for independent advertising to support or oppose political candidates.

Colorado?s secretary of state, Bernie Buescher, had suggested he believes Citizens United invalidates two parts of Amendment 27, passed by voters in 2002, that bar spending on political advertising by corporations and unions.

The state Supreme Court on Monday found that Citizens United conflicts with Amendment 27, according to an Associated Press article. You can see the Colorado Supreme Court ruling  by clicking here, and you can read more about Citizens United in Gavel Grab.
