An interesting opinion from Khatib v. County of Orange, with Judges Trott and Wardlaw in the majority, and Chief Judge Kozinski in dissent. The dissent is characteristically colorful, and in my view quite persuasive. Thanks to Gabriel Malor for the pointer.
