Legal Ethics odds and ends (June 9, 2010)

ADVERTISEMENTS
Lawyer and law professor Peter Erlinder, charged with genocide denial in Rwanda, has been denied bail.  The facts are hard to determine, but it appears that his alleged crime is simply the act of advocacy on behalf of persons accused.  The news article relates that Erlinder's health issues are being exacerbated in jail.       .  .  .  .  .      Due to California's restrictive practice rules regarding foreign lawyers, relatively few international arbitrations are held in California.  Adding the words "or foreign jurisdiction" to a California statute would align California with the approach of other commercially significant states.       .  .  .  .  .       A counseling program in the Northern District of California has reduced the number of suicides by people accused of child pornography.       .  .  .  .  .       We've asked before and the issue is bubbling up again: why aren't all ethics opinions readily and freely available online?  (h/t: ABA's 20/20 listserv, by way of Law Firm Risk Management Blog)     .  .  .  .  .       "Will making [Canadian] lawyers civil make them soft?"       .  .  .  .  .       The Supreme Court of Georgia's new opinion in State v. Frederick J. Hanna & Associates, P.C.,  declines to interpret a debt collection law to apply to law firms acting on behalf of their clients.  There is a dissent.  As we've noted in the context of federal laws and US Supreme Court opinions, if laws of general commercial applicability come to apply to law firms, firms will need to move to a "compliance culture."       .  .  .  .  .       This sad case of a lawyer screaming ethic and other slurs in court might be mentioned in those CLE presentations about bias in the profession.       .  .  .  .  .       Scam artist loses malpractice claim against his lawyers.       .  .  .  .  .       in People v. Weber, a California Court of Appeal wasn't impressed by the defendant's efforts to waive his right to counsel, undermine the trial and then argue that his decision to waive his right to counsel wasn't competent and knowing.
