The Sacramento Bee has a story today about attorney Joseph George, who is utilizing what law professor Larry Levine calls "a creative legal theory" to combat clergy sexual abuse: suing the California Catholic Church for fraud and negligence.
George has filed two suits, one in Los Angeles and another in Fresno, based on the claim that church leaders acted fraudulently by allowing priests to continue to serve after their alleged crimes were reported. Church leaders counter that George is trying to circumvent the statute of limitations law, which says complaints must be filed by the victim's 26th birthday or within three years of the date of discovery.
The AP reports that several similar suits have been filed in other states, including about 20 fraud cases in Minnesota in the past year.
