Today’s 7-2 opinion by Justice Thomas in Washington State Grange and Washington v. Washington State Republican Party (06-713) and (06-730) is now available here. Justice Scalia filed a dissenting opinion, in which Justice Kennedy joined.

The Court upheld against a facial challenge a Washington state primary system that allowed the top two vote-getters to advance to the general election, regardless of party affiliation. An account from Mark Sherman of the Associated Press is available here.
