New U.S. Supreme Court (SCOTUS) Justice Elena Kagan Hires Her Law Clerks and Goes With Experience: Is This a Clue to Her Future Judging?

ADVERTISEMENTS

Tony Mauro at The National Law Journal via Law.com reports that new U.S. Supreme Court (SCOTUS) Justice Elena Kagan -- by her second workday in office -- had already hired four experienced law clerks. See Kagan Hires Her Law Clerks.

U.S. Supreme Court clerks are very important. Although of course the Justices decide the cases, clerks do a lot of the footwork.

In our opinion, Kagan's choice of experienced clerks gives a good insight into her future performance as a Supreme Court Justice, which is likely to be marked by legal and political moderation. We expect Kagan not to be content to take a role as a Justice on the fringe and she is thus more than likely to give Justice Kennedy a run for his money as a swing Justice "in the middle".
