Justice Stephen Breyer, the circuit justice for the Seventh Circuit, has called for a response in Burris v. Judge (10A272), in which Illinois Senator Roland W. Burris is seeking a stay of a federal judge’s order that will keep his name off the ballot in November’s election to fill the two months remaining in his term. Lyle covered Burris’s application for a stay in detail when it was filed last week. The response to the application is due by noon Eastern on September 20.
