Legal Ethics Items (September 21, 2010)

ADVERTISEMENTS

  • ABA Journal: Washington state settles with LegalZoom after agreement on a handful of UPL and advertising issues are resolved.  The state believed that if LegalZoom wasn't doing legal work, it shouldn't offer price comparisons to legal work.  (I'm not sure I agree with that part of the settlement -- although, admittedly, I haven't read the source documents.  If non-legal work is cheaper and is a market substitute, shouldn't the market be told?)
  • Washington Post: "An inmate shouldn't die because of his lawyers' error."  It concerns the Cory Maples case.
  • California Attorneys' Fees Blog: $123,000 in costs for wrongfully denying a request for admission.  If this kind of result were rigorously applied, it might drive down the litigation costs of some kinds of disputes.  I once tried a case in tax court where you had a duty to stipulate to uncontested facts.  It felt oddly non-adversarial but it did lead to the streamlining of the dispute.  In the end, the IRS refused to stipulate to several of the big uncontested facts, and they suffered no penalty for refusing, so it wasn't a perfect solution.
  • State v. Lindmeier: From Nebraska, a classic example of run of the mill trust account screw-ups.  Six month suspension.
