Supreme Court Rejects Prosecutor's Appeal of Kentucky Case

"US Supreme Court turns away Ky. in death case," is the AP report, via the Lexington Herald-Leader. The U.S. Supreme Court has declined to take up Kentucky's effort to reinstate a death sentence for a man convicted of murder. The high court on Monday rejected the case of Phillip L. Brown, who was convicted in the 2001 slaying of Sherry Bland in Columbia in Adair County. The Kentucky Supreme Court in June ruled that Brown should not have faced a death sentence at a retrial in 2006 because he was given life in prison at his first trial three years earlier. The state high court ordered a resentencing for Brown. Kentucky prosecutors asked the justices to take the case in an effort to keep the death penalty option open.
