: SCOTUSBLOGChanges in February arguments
By Lyle Denniston
The Supreme Court on Monday released a revised oral argument calendar for the February-March sitting, which starts on Tuesday, Feb. 22, after a legal holiday on Feb. 21. The Court has dropped from the schedule for Feb. 23 the case of Madison County, et al., v. Oneida Indian Nation (10-72), after it was returned earlier Monday to a lower court for a new look. As a result of this and other shifts, the Court will not be holding an afternoon session on Feb. 22.
In another change, the Court has switched the two cases set for argument on March 2, presumably to accommodate Justice Elena Kagan, who is not participating in Ashcroft v. Al-Kidd (10-98). That case will now be heard at 11 a.m. instead of 10 a.m., allowing her to hear the first argument of that day and then to step aside for the Ashcroft hearing.
