Freedom to Differ Freedom to Differ

A blog that speaks freely about legal issues facing the media and the internet. It mainly covers issues relating to the legal regulation of the internet and the media, but at times Constitutional law issues and politics are discussed. While the focus is on Australia, developments in other nations around the world are considered as well.

Posted on January 29, 2010
The New Yorker, which usually holds its article archives behind a paywall, just opened up a bunch of stories written by J.D. Salinger. Earlier today, his son told the AP that the Catcher in the Rye author passed away in his home. Read some of Salinger's classics from the New Yorker, written between 1946 and 1965: ?Slight Rebellion Off Madison? (December 21, 1946) A Perfect Day for Bannanafish? (January 31, 1948) ?Uncle Wiggly in Connecticut? (March 20, 1948) Just Before the War with the Eskimos? (June 5, 1948) ?The Laughing Man? (March 19, 1949) For Esmé?With Love and Squalor? (April 8, 1950) ?Pretty Mouth and Green My Eyes? (July 14, 1951) Teddy? (January 31, 1953) ?Franny? (January 29, 1955) Raise High the Roof Beam, Carpenters? (November 19, 1955) ?Zooey? Jurors and the internet

Posted on January 26, 2010
I've written before how the access jurors have to the internet potentially poses a threat to our judicial process, so I was interested to read this blog post that chronicles how courts in Maryland, New Jersey and Florida have declared mistrials following juror internet research: Appeals courts in Maryland and New Jersey appear to be the first to reverse jury verdicts because of social media use by jurors during trial...

US Supreme Court uses "blog" in an opinion for the first time

Posted on January 23, 2010
Yesterday's controversial Supreme Court campaign finance decision was, at least in one way, a win for online-publishers everywhere. Justice Kennedy's opinion was the first ever high court one to use the word "blog." As Eugene Volokh and Josh Blackman noticed, the text can be found on page 49: Soon, however, it may be that Internet sources, such as blogs and social networking Web sites, will provide citizens with significant information about political candidates and issues...
