Representative Gabrielle Giffords (D-AZ) has introduced much needed legislation that would link the H-1B cap to market demands and also provide cap exemptions for American-educated professionals in the sciences, engineering, technology and math. There are also provisions that largely target outsourcing companies, something that will probably appeal to many H-1B critics...

Posted on March 12, 2008
The protectionistas will no doubt come up with a million arguments why this is not true, but facts are facts. For every H-1B position requested, US companies hire five US workers. Protectionistas argue with anecdotes because they don't have the facts...

IMMIGRANT OF THE DAY: HIROSHI MOTOMURA - IMMIGRATION LAW PROFESSOR

Posted on March 11, 2008
Most immigration lawyers in the US never took an immigration law class in law school. It's not that we avoided the class. It's that the class was never offered. Most law schools don't offer the course or only offer it every once in a while and as a two credit class that seems like it's more of an afterthought...

IMMIGRATION LEGISLATION MOVING IN HOUSE?

Posted on March 10, 2008
The Associated Press reports that efforts to force the Shuler SAVE enforcement bill may have enough support to force its hearing on the House floor without going through the committee voting process. The highly unusual move is part of an effort by House Republicans to force the anti-immigration measure to be debated before the the November election...

ICE HARRASSES IMMIGRATION LAWYER AT HIS HOME

Posted on March 10, 2008
ICE officers executing warrantless searches and using intimidation tactics to unlawful entry to places of residence and work sites is something I've been reporting on in recent months. But this one is really interesting. And worrisome. Kevin Crabtree knows the law and can assert his rights...

WILL H-2A CHANGES MAKE AGRIGULTURAL WORKER PROGRAM FUNCTION BETTER?

Posted on March 09, 2008
The Bush Administration recently announced changes to the H-2A program that are designed to make the program easier for employers to use. The program has been so complicated that even most immigration lawyers don't understand how it works. There is no cap on the H-2A program...

The excellent New York Times reporter Nina Bernstein writes this morning on the archiving of a massive number of documents chronicling the resettling of Holocaust refugees in the United States in the 1950s. MISSISSIPPI PASSES EMPLOYER SANCTIONS BILL WHICH CRIMINALIZES UNLAWFUL EMPLOYMENT

Posted on March 07, 2008
[Note: I've updated this from the original post after I discovered the shocking criminalization provision noted at the end. This is a pretty serious elevation of what states have been doing and it will test Governor Barbour's seriousness about defending the US Constitution if he goes along with signing the bill] Just days after Utah passed its employer sanctions law, Mississippi now becomes the latest state to go down the path of independently enforcing immigration law...

CONGRESSIONAL REPUBLICANS TURN UP THE RHETORIC ON IMMIGRATION

Posted on March 06, 2008
Hopes by some supporters of GOP presidential candidate John McCain that Republican members of Congress would tone down efforts to make immigration a wedge issue in the lead up to the November election are being dashed. McCain is hoping to avoid the defection of large numbers of Hispanic voters to the Democrats and has hoped to convince those voters that the GOP is not an anti-immigration/anti-Hispanic party...

One of her pieces was performed by members of the New York Philharmonic during their historic musical diplomacy tour of North Korea last month.

Posted on March 02, 2008

One interesting passage may explain why Americans are not buying in to the rhetoric: Mr...

If John McCain becomes President, he will be the first one born in another country. Yes, you read that correctly. John McCain was born in Panama. DOBBS: "WE'VE NEVER OPPOSED LEGAL IMMIGRATION"

Posted on February 29, 2008
Are you kidding me? Dobbs was airing an incredible report last night actually insinuating that the people complaining about hate speech emanating from his show are actually the real bigots when he made this little doosy of a statement. I knew this was a lie, but how to convince readers that I'm not just being mean to old Lou? Then I remembered that CNN makes transcripts of all of its shows available online...

The bill would also create an H-1B cap exemption for certain doctors that work in underserved areas as well as rewarding the service with an exemption from employment-based green card caps...
