BROWARD WAR!!!
Posted on October 05, 2010Are you curious about the war? Well, according to Judge Carlos Rodriguez's retort to ASA Jennifer Hilal, "Curiosity is for cats." The title of the post links to the SAO's motion to recuse the judge. One of 450 (!!!!) motions filed. Yes, it's war in Broweird County, and the difference here is that it's the SAO going to war against Judge Carlos Rodriguez...
FIRST MONDAY IN OCTOBER : 2010 EDITION
Posted on October 04, 2010It's the First Monday in October, and you all know what that means: Yes, they now change the soup menus in Au Bon Pain to reflect the Fall Harvest, but it is also the opening session of the United States Supreme Court. Nick Allard of Politico has this Op Ed piece: "Mr...
MNF DOLPHINS EDITION
Posted on October 04, 2010First the bad news: Suicide deaths include Colby (and now we don't have to deal with that headache anymore) and Peter Sauter. Long time "pooler" Dan Lurvey really did commit suicide by picking the Bills over the Jets. BTDT stayed alive with the Jets, as did Nick Basso...
NFL WEEK 4 2010
Posted on October 03, 2010Good Sunday morning! Before we begin, there is an excellent comment in the previous post by someone who is well versed in the procedures of what occurs when a pregnant inmate gives birth while in custody. We are proud that we have such a diverse group of readers...
IN RE GLICK
Posted on October 02, 2010More comments on the Glick sentencing, and the tide seems to be turning against the Defendant. There is apparently an article in the Herald today, but we can't find it on line. This comment appears to sum up the prevailing sentiment:Anonymous said...As a defense attorney, I got to admit that at 1st I believed the facts posted on the defendant's website and thought the punishment was way harsh...
FIRST FRIDAY IN OCTOBER
Posted on October 01, 2010Good Friday Morning!!!! The Dolphins play the cheaters at home Monday night, and speaking of Monday....while the first Friday is October is meaningless, the First Monday is not. We welcome a new Supreme Court and the first term of Obama's second appointment- Justice Kagan...
A DISTURBING CASE
Posted on September 29, 2010As criminal defense attorneys we are often confronted with the dark side of human nature. We are called upon to defend those that may appear indefensible. We see acts so brutal, so ultimately devoid of humanity that we often have trouble sleeping at night...
TROPICAL STORM NICOLE
Posted on September 28, 2010ARE COURTS CLOSED WEDNESDAY? Great question. You would think, with a tropical storm approaching, that the 11th Circuit Website might have an update. But then again, you would think our Chief Judge would give a damn about these concerns. And you would be wrong on both counts...
BUJU'S LAST STAND?
Posted on September 27, 2010Good Monday morning!!! While the Reggae world watches and hopes, Buju Banton sits in a lonely holding cell in Federal Court in Tampa while a jury decides his fate. You know what they say: "You can beat the rap, but you can't beat the ride."Good luck to Buju and Mr...
FED ARRESTED-loose briefs.
Posted on September 27, 2010AUSA Sean Cronin's booking photo. Miami Federal Prosecutor Sean Cronin, who of late was most notorious for taping our fellow blogger David O Markus, in the case in which he lost and then got referred to the Bar by Judge Gold, has been arrested for Lewd and Lascivious Assault on a Child and Resisting Arrest without Violence to an office...
NFL WEEK 3 2010
Posted on September 25, 2010Sorry for the spotty post, but we're trying to fly home and internet access is dicey. Our record is 5-3 and were plus 625 Bujus for the year. We love the Eagles -3 at JAX +400 Vicks;Washington -4 over Rams for +200 McNabbs. Cleveland at Ravens...the line is 37, and under seems like a lock...
BUJU JURY JAMMIN
Posted on September 23, 2010Well, Mr. Markus kept the jury out Thursday in the trial of Reggae Star Buju Banton. The jury returns Friday, and while we wish Mr. Markus and his client the very best, we loathe Friday verdicts. Earlier DOM put his client on the stand to testify that he was just jammin...
BROWIERD .....AGAIN
Posted on September 22, 2010BREAKING: 3rd DCA affirms Judge Lederman on Gay Adoption case, here. Hat tip to South Florida Lawyers, who had it up first. We take this story in toto from the JAA Broward Blog. We are often asked why we despise Broward so much. In all seriousness, much of it comes down to the cowardly- and we say- unethical stance of the Broward SAO to "let the jury decide" when confronted with cases in which the client is clearly innocent...
GO DAVID GO
Posted on September 21, 2010Nobody is rooting harder for our fellow blogger and brother in arms than we are for David O Markus as he begins his defense of international reggae star Buju Banton in Tampa. The title of the post links to the St. Pete Times article on the start of the trial...
BAR RESULTS ARE IN
Posted on September 20, 2010Football first of course: We ended up week two with a record of 5-3 and plus 625. No MNF pick but how can you go against the Saints with 10 days to prepare when SF looked as bad as they did and internally they are reported to be in disarray? We are 2-0 versus Mr...
A TALE OF THREE JUDGES
Posted on September 17, 2010Our tale of Three Judges starts with Judge Diane Ward, who takes over from Judge Peter Lopez in ROC court. She wanted and she got it. But we have to question why in the world a judge would want the mind numbing assignment of handling hundreds of robbery and strong arm robbery cases with more minimum mandatories than you can throw a Florida Legislator at, as these cases tend to dominate the ROC court docket...
NFL WEEK 2 2010
Posted on September 17, 2010We start week two 3-1 and a healthy 345 Bradys in the blue. Our first pick, is the Cheaters -3 on the road over the J..E..T..S...over over blown. We've seen better offenses run by Miami Highschools than the Jets have. The Pats have a dominant offense, and decent defense, and the Jets are deep in a whole, facing going 0-2 in their new house, and a blowhard coach that doesn't know when to shut up...
ON THE OUTSIDE...LOOKING IN
Posted on September 16, 2010That's where the inhabitants of the REGJB will be when the 11th circuit gets around to electronic filing. The Feds have electronic filing, and it actually works very well. Everything is on line and accessible. And now that the 11th Circuit (Motto "Better late than never") is considering electronic filing, the first five divisions to get the system will all be in civil court...
FALSE CONFESSIONS AND WHAT NOT TO SAY AT SENTENCING
Posted on September 15, 2010To our dear state court robed readers, please, in all seriousness, if you read anything this week, read this NY Times articles on False Confessions, here. It's too important a subject for a judge to not educate himself or herself on. The chances are that a case of this nature will cross a judge's docket and the chances are very high that if even half the judges of the REGJB read this article, they already have a case in front of them in which the confession is suspect at best...
ARTHUR, ED, AND MICHAEL.
Posted on September 15, 2010Before we begin, an update courtesy of a reader, on the issue of Arthur hearings being held before an information is filed: Anonymous said...In Cordarius Benjamin v. State, Case No 10-1801, defendant filed writ of habeas corpus on July 14 to require Judge Fernandez to hold an Arthur hearing immediatly before 21 days had run or an information had been filed...
BUSY MONDAY
Posted on September 13, 2010Was it us or was the REGJB hopping this morning? And a quick check amongst judges and Pds showed that next week is even busier. Summer is over folks. Arthur hearings.....An enterprising PD was perusing Arthur the other day and came upon something so simple, yet fairly startling...
SISSELMAN v. STATE EX REL ARTHUR
Posted on September 13, 2010What do sharp and experienced lawyers do when they're not in trial or taking depositions? They challenge assumptions. That's what PD David Sisselman is doing. He emailed us an analysis of the (in)famous Arthur case that is the basis for Arthur Hearings throughout the State...
NFL WEEK ONE SUNDAY 2010
Posted on September 11, 2010Here we go. What you all have been waiting for since that Super Bowl Sunday in February. First off, our lines come from here. This is as difficult a week as we have ever seen. Almost every favourite is on the road, so home dogs are barking loudly. Personally, we might just put a nickel on every home dog and see where we end up...
LURVEY AND PORTA TO THE RESCUE
Posted on September 10, 2010How many people does it take to rescue a kitten? Two lawyers, one FHP Trooper, and one good samaritan tow truck driver. Check out the video of REGJB regulars Dan Lurvey and Bo Porta rescuing a kitten that somehow ran up into Lurvey's car engine when he stopped at an intersection...
SATURDAY LEGAL SEMINAR
Posted on September 10, 2010Good Saturday morning. College football is in full swing today. The Canes play Ohio State today and this will be a good early test. If the Canes can win in Ohio today, they will be in the mix for a bowl game this year. There is a free legal seminar today at the Miami Shores Recreation Complex...

He is reported to be ok and not needing hospitalization...
NFL WEEK ONE 2010
Posted on September 09, 2010Here it is at last- the opening Thursday night football game of the 2010 season. It seems like it was a long time ago when we were telling you to take the Saints and the money line over Indy. And for long time and careful blog readers, we have been winners- big winners- two out of three years...
