Library of Congress Quietly -- and Slowly -- Harvesting Legal Blawgs

Posted on April 09, 2010
It could just be the result of my living in the Washington, D.C., area for decades, but I've always assumed that the existence of the "Library of Congress" is pretty well-known to lawyers and others. For any of you not familiar with this amazing resource, it is "the nation's oldest federal cultural institution and serves as the research arm of Congress...

George Lucas and Reed Elsevier Conspire to Deny Blawger Press Credentials

Posted on April 08, 2010
My job here at LBW is mostly to keep you all informed of what other law bloggers are up to. But some of my colleagues take it upon themselves to get out there on the front lines. Breaking stories, living on the cutting edge of the issues that matter. So I'm a little outraged at the way Joel Welch of Law is Cool (left, with Greedo) was dissed when he attempted to fulfill his mission...

Nevada Governor Hires Special Counsel to Join Healthcare Lawsuit After AG's Refusal

Posted on April 08, 2010
Two weeks ago, we pointed out that the debate over the new healthcare law had resulted in some infighting, with several states' governors on opposite sides of the issue from their own attorneys general. Gov. Jim Gibbons, of Nevada, really really didn't like that AG Catherine Cortez Masto refused to sign onto the lawsuit challenging the law's constitutionality...

Hollywood Doesn't Want You Betting on -- or Against -- It

Posted on April 08, 2010
How much do you think the new "Nightmare on Elm Street" is going to rake in when it opens in a few weeks? You wanna bet? Sorry. I meant "Would you be interested in purchasing a futures contract?" Even if you would be interested, the movie studios and several lawmakers don't necessarily want you to have that option...

D.C. AG and Federal Judge Go at It Over Old Case

Posted on April 08, 2010
In a courtroom scene that sounds like it might have been worthy of prime time air (and, unless these yahoos prevail, it sounds like there should be a slot open sometime soon), District of Columbia Attorney General Peter Nickles and U.S. District Judge Ellen Huvelle traded barbs yesterday at a hearing on the District's most recent attempt to get out from under a 32-year-old consent decree in a class action brought on behalf of residents of Forest Haven, a now-shuttered institution for people with developmental disabilities...

Wednesday's Three Burning Legal Questions

Posted on April 07, 2010
Here are today's three burning legal questions, along with the answers provided by the blogosphere. 1) Question: My fellow flight attendants and I are in a bitter wage dispute with the airline. We've tried strikes and everything we can think of, but we are still owed ?7 million...

Introducing the 'Dangerous Quadriplegic' Doctrine

Posted on April 07, 2010
From the same profession that brought you the "fertile octogenarian" rule centuries ago comes a new one: the "dangerous quadriplegic" doctrine. Via Lowering the Bar, today I came across Martinez v. Board of Parole Hearings (PDF), an opinion issued yesterday by the Court of Appeal of the State of California, Third Appellate District...

Who Says You Need to Go to Law School to Be a Lawyer?

Posted on April 07, 2010
The idealawg blog had a post yesterday flagging an interesting article on people becoming lawyers in Washington state without ever going to law school. The Seattle Times reports that Washington allows candidates with a bachelor's degree and a full-time job to become lawyers by, essentially, working as an apprentice under a sponsoring attorney...

Extramarital Affair? Let's Just Call It Exercising Your First Amendment Rights

Posted on April 07, 2010
It obviously takes guts to be a firefighter. But I say it takes a special kind of guts to be a firefighter who has an extramarital affair with a subordinate, gets demoted for it, and then argues to the 11th U.S. Circuit Court of Appeals that the demotion violates your First Amendment right to "intimate association...

News Flash: Google Scholar Contains an Error

Posted on April 06, 2010
This morning on the FourthAmendment.com blog, it was reported that Google Scholar has a boo boo. Apparently, the citations that should link to the Supreme Court's decision in Virginia v. Moore all linked to the order denying the ABA's request to participate as amicus, rather than the decision on the merits...

Turkewitz Hoax Redux: The Joke That Won't Die

Posted on April 06, 2010
On Friday, I posted about the rather elaborate (and well orchestrated) April Fools' Day prank pulled by blawger Eric Turkewitz. I ended my post by saying that, as time went on, "it should be fun to find out who was in on the joke, and who was suckered...

Lohan Needs a Personal Forum Shopper?

Posted on April 06, 2010
While the Honorable Judge Carton has already ruled on Lindsay Lohan's suit against E*Trade arising out of the hilarious "milkaholic" baby commercial, the real suit, in a testament to the efficiency and rationality of our judicial system, is still pending...

The Taxman Cometh, Soonish, for Vegas Drivers and Doormen

Posted on April 06, 2010
It's been almost a month since I have had an opportunity to mention strip clubs here on LBW, whereas both Above the Law and the WSJ Law Blog got to do so less than two weeks ago. Once again, though, Meeting the Sin Laws alerted me to a story I just couldn't ignore...

Monday's Three Burning Legal Questions

Posted on April 05, 2010
Here are today's three burning legal questions, along with the answers provided by the blogosphere. 1) Question: I'm tired of seeing kids with their pants hanging down around their thighs. When will my elected officials finally take action against this scourge? Answer: New York State Senator Eric Adams is on it...

Must Product Placements on Television Shows Be Disclosed?

Posted on April 05, 2010
Last week's episode of new ABC sitcom "Modern Family" took what seemed a story line about one of its main character's love of gadgets and seemingly morphed it into a lengthy ad for Apple's iPad. The episode aired shorty before the release of the iPad last week, and it raises an interesting question: Does the Federal Communication Commission regulate product placement and, if so, are networks required to disclose placement deals to viewers? The Los Angeles Times reports that the FCC's Sponsorship Identification rule states that "when money or other consideration for the airing of program material has been received by or promised to a station, its employees or others, the station must broadcast full disclosure of that fact at the time of the airing of the material, and identify who provided or promised to provide the consideration...

McDonald's Nude Cellphone Photos Lawsuit Settles

Posted on April 05, 2010
A settlement in a lawsuit filed in 2008 in Arkansas state court strikes a blow for women everywhere whose husbands leave their cell phones (containing nude photos of their wives) at fast food restaurants. In July 2008, Tina Sherman's husband Phillip Sherman did just that, accidentally leaving his phone at a McDonald's in Fayetteville, Ark...

Businesses Targeted by Law School Legal Clinics Hit Back

Posted on April 05, 2010
In March, law students in the legal clinic program at University of Maryland School of Law sued chicken supplier Perdue and farmers it contracts with for allegedly polluting the Pocomoke River by allowing chicken waste to flow to the Chesapeake Bay. Perdue's response? According to an article this weekend in The New York Times, Jim Perdue, the company's chairman, went to the state legislature in Annapolis to ask lawmakers for help, and got a prompt response...

Turkewitz White House Law Blogger Announcement Has Legs Despite Mediocre Use of Photoshop

Posted on April 02, 2010
Yesterday, Eric Turkewitz, whose New York Personal Injury Blog is part of the Law.com Blog Network, made a pretty huge announcement. Namely, that he had been tapped as the first official White House law blogger. The "news" spread like wildfire. It was "picked up" by, among others, Above the Law and The New York Times...

Lawyers Masquerade Online as VA Hospitals to Attract Plaintiffs

Posted on April 02, 2010
Though Overlawyered often exposes the lighter side of things legal, yesterday it picked up a story about some pretty deplorable lawyer advertising tactics. Fortune had a lengthy article about a handful of law firms that had created Web sites with urls like www...

Cell Phone 'Death Sentence' Overturned by Florida Appeals Court

Posted on April 02, 2010
So you're hanging out, just observing juvenile court in Orange County, Fla., from the gallery, and your cell phone goes off. It ain't on vibrate. It's set on high volume, and your ring tone is something "musical." Maybe it's this song. Or this one. It's not your fault...

Thursday's Three Burning Legal Questions

Posted on April 01, 2010
Here are today's three burning legal questions, along with the answers provided by the blogosphere. 1) Question: I have allergies and I'm thinking of taking a new drug called XYZAL. Is there anything I should know about this drug? Answer: "Do not take XYZAL if you are allergic to XYZAL...

The iPad Is Coming, and Tablet Legal Is Gearing Up

Posted on April 01, 2010
In February I wrote about Tablet Legal, a new blog from Portland, Ore., attorney Josh Barrett. Barrett launched TL as a shrine to all things lawyers can do with an iPad, Apple's latest gadget du jour, weeks before anyone had even seen one in person. So with the iPad's imminent release this Saturday, these are heady times for Barrett and TL since, in the words of Nathan Arizona Sr...

New Blog Focuses on Contract Standards and Drafting Automation

Posted on March 31, 2010
It's an honor to welcome to the blogosphere the Contract Analysis and Contract Standards blog. One week and three posts into its existence, the blog, authored by Kingsley Martin, president of kiiac LLC, has gathered some good information, and raised some interesting questions, bearing on the prospects of lawyers using technology to automate drafting of contracts and other documents...

Peeps Eviction Lawsuit Delayed

Posted on March 31, 2010
The timing was too deliciously good to stick. The courtroom showdown over a Colorado woman who was evicted from her apartment for refusing to pay rent after her display of Easter decorations, including the cutest damned snacks in the world, Marshmallow Peeps, was removed by her landlord, has been continued until June...

BitTorrent Users: Prepare to be Spam-igated

Posted on March 31, 2010
THR, Esq. is reporting on a wave of new lawsuits targeting users of the file-sharing service BitTorrent, accusing them of illegally downloading copyrighted movies. THR reports that 20,000 individual users have already been named in these suits, and that another suit naming an additional 30,000 is coming down the pike...

WestlawNext Update: $3,400/Hour Legal Research Has Arrived

Posted on March 31, 2010
We (and everybody else) have previously reported on the beginnings of the rollout of WestlawNext. Part of the marketing initiative was to conduct "roadshows," where the Thomson Reuters folks could get a bunch of lawyers and/or academic users in a room and demonstrate why their new product was the proverbial greatest thing since sliced bread...

Blonde Justice on the Most Random of Victim Statements

Posted on March 30, 2010
This week on the Blonde Justice blog (which I now recall I started following because I liked its name and its tagline, borrowed from Jay-Z's "H to the Izzo"), the anonymous Blonde Justice writes about an odd victim statement she witnessed in criminal court...

Bitter Lawyer Talks to WSJ Law Blog's Ashby Jones

Posted on March 30, 2010
I'm a regular reader of the works of Ashby Jones, the head writer at the The Wall Street Journal Law Blog, and was pleased to see a nice profile of him on Bitter Lawyer last week. It also struck me that I could achieve a historic level of "legal blog navel gazing" if I could have Legal Blog Watch write about Bitter Lawyer writing about the Law Blog's Jones, and that was an opportunity I could not pass up...

Allow the Awesomeness of This Supreme Court Citation Video to Wash Over You

Posted on March 30, 2010
I'm not sure there's too much to say about the academic work below, other than the fact that if you were a Ph.D. candidate at the University of Michigan, you, too, could be making videos about the "Development of Structure in the Citation Network of the United States Supreme Court" from 1800-1830...
