Lawyer: Duke Univ. arrests violate church-state separation

By By The Associated Press

DURHAM, N.C. — An attorney is challenging his client?s alcohol-related traffic arrest, saying the separation of church and state should bar Duke University?s Police Department from having the authority to make arrests.

Multiple media outlets reported that attorney Bill Thomas filed a motion Nov. 23 to dismiss the charge against 19-year-old Thomas Holloway. Thomas contends the traffic stop on Duke?s East Campus was illegal because of the university?s affiliation with the United Methodist Church.

The state Court of Appeals in August stripped Davidson College police of their power to arrest, saying allowing state-certified police at the Presbyterian school created inappropriate ties between government and religion.

The state Supreme Court has delayed implementation of the Appeals Court decision while it considers Davidson?s appeal.
