Through the sheer elegance of minimalist language, the Supreme Court -- without dissent -- kept Melendez-Diaz in its rightfully supreme place. Here is the Court's per curiam Briscoe opinion from January 25, 2010: "SUPREME COURT OF THE UNITED STATES No. 07?11191 MARK A. BRISCOE AND SHELDON A. CYPRESS, PETITIONERS v. VIRGINIA ON WRIT OF CERTIORARI TO THE SUPREME COURT OF VIRGINIA [January 25, 2010] PER CURIAM. We vacate the judgment of the Supreme Court of Vir-ginia and remand the case for further proceedings not inconsistent with the opinion in Melendez-Diaz v. Massa-chusetts, 557 U. S. __ (2009). It is so ordered." Briscoe v. Virginia, __ U.S. _ (Jan. 25, 2010).Full post as published by Underdog on January 26, 2010 (boomark / email).
