Legal Ethics News (October 27, 2010)

ADVERTISEMENTS
  • Capital Defense Weekly rounds up recent cases, including Earp v. Cullen, a Ninth Circuit case where the defendant was not given a full and fair evidentiary hearing on a claim of prosecutorial misconduct.
  • California Attorneys Fees looks at a recent SLAPP case holding that lawyers "cannot be hit with adverse fee awards by SLAPP victors."
  • Wharton v. Bell: a new Louisiana opinion reversing a summary judgment that had been granted to a law firm in a malpractice case.  The appellate court acknowledged that the plaintiff had reached a settlement in the underlying matter, but noted that the settlement didn't preclude the possibility that the the lawyers had caused plaintiff damages on different aspects of the underlying case.
  • Sylvia Novinsky, Assistant Dean at UNC, is interviewed about pro bono practice in law school settings.
  • Patterico: An act of prosecutorial discretion -- to not pursue a rape prosecution -- has resurfaced in the Colorado campaign of Ken Buck to be elected to the US Senate.  What I found interesting about the post was not the politics but rather the transcript of what Buck said to the complainant about why he would not pursue the prosecution.  Although the topic could be controversial in a classroom setting, it might be instructive for students to read what a real DA said to a real complainant in a case like that.
  • Law of Criminal Defense: a defense lawyer's exculpatory comments to the press in a sensational murder case raise issue of possible contempt.
  • Judith McMorrow (BC) has a new paper up, "Legal Responsibility in an Uncertain Profession: Legal Ethics in China."
  • TheLawyer: Fumata nera rises from the chimney at Clifford Chance's London office.
  • Slightly off topic: Legal History Blog looks at a new book by Peter Tiersma -- Parchment, Paper, Pixels: Law and the Technologies of Communication --  on how the technology of communication affects the practice of law and the law itself.  Here's the book's introduction.
  • Slightly off topic: Berkeley to hold conference on law and meditation.  I saw Charles Halpern speak briefly on that topic at Boalt, and was impressed with his social justice lawyering and his reputation among top flight legal minds.
