: Eastern District of Texas Federal Court PracticeDefense verdict for Google & Yahoo! in BrightResponse case
By Michael C. Smith
Monday a Marshall jury in Judge Chad Everingham's court rendered a verdict in favor of defendants Google and Yahoo! in Bright Response v. Google, 2:07cv371.
The jury found that none of three asserted claims were infringed literally or under the doctrine of equivalents by either Google's AdWords or Yahoo!'s Sponsored Search products. The jury further found by clear and convincing evidence that all three claims were invalid under public use, obviousness, and lack of sufficient written description, and the patent was also invalid for improper inventorship.
