: Legal Pad | LAChallenge to county and state benefits for LA judges dismissed, again
By Richard Binder
An appellate court justice has dismissed a taxpayer lawsuit challenging the dual payment of county and state benefits to Los Angeles County Superior Court judges for the second time in less than three years. In a 17-page decision, Justice James A. Richman found that the benefits were covered by legislation passed earlier this year. The Legislature passed a bill in February stating that counties giving benefits to judges as of July 1, 2008, could continue to do so.The legislation prompted the county to again ask for dismissal of the case, brought by Harold P. Sturgeon in 2006, via a motion heard July 13 by Richman. Sturgeon's lawyers, meanwhile, filed a separate motion asking Richman to find that the Legislature abdicated its duties with the February bill, which Richman rejected.
