Kaleidescape victory overturned in another victory against DVD copying

Right on the heels of the victory against Real and its DVD-copying technology, California's 6th District Court of Appeal threw out a trial court win for Sunnyvale's Kaleidescape yesterday.  Kaleidescape also makes high-end home entertainment systems that allow people to copy and store DVDs.

Kaleidescape scored a rare victory against the DVD Copy Control Association, which licenses the keys to the encryption to device makers like Kaleidescape and RealNetworks, in a 2007 trial in Santa Clara County Superior Court. The trial court found that the license agreement didn't include prohibitions on replaying the DVD's content when the disc is not in the player.

The DVD CCA had accused both Kaleidescape and RealNetworks of bypassing technological locks on DVDs and breaking a licensing agreement by allowing DVD owners to copy their discs.
