Legal Food Fight Over 'Footlong' Sandwiches Back on the Menu

Remember last year when Subway began sending cease-and-desist letters to other sandwich sellers, telling them to stop offering items with the description "footlong"? Now, an Iowa business, Casey's General Stores, is dishing out some legal action of its own. As the Des Moines Register reports, Casey's on Friday filed a petition in U.S. District Court, asking for a jury trial and seeking a declaration that the term "footlong" is generic and does not violate any trademark owned by Subway. Casey's also seeks unspecified damages for what it calls "frivolous" claims by Subway. Written by Law.com managing editor Paula Martersteck.
