: Legal Pad | LANew OC DNA program raises privacy and safety concerns
By Richard Binder
Orange County District Attorney Tony Rackauckas, embroiled in a long feud with the Sheriff's Department
over who should oversee DNA gathering and
analysis, quietly rolled out a program that allows OC defendants charged with some misdemeanors and low-level drug
felonies to go free in exchange for a DNA sample. Some judges and defense
attorneys worry that the program, dubbed "spit and acquit" by its
critics, could lead to abuses of power, undermine the privacy rights of
defendants and affect public safety.Susan Kang Schroeder, a
spokeswoman for the district attorney's office, said the program is a
better solution for prosecutors in an overcrowded system than the drug
programs, which have a high rate of recidivism. But Jean Rosenbluth, a law professor at the University of Southern California's Gould School of Law and former federal prosecutor, claims it "raises the specter of coercion." Click here for the full story.
