Brain Injury: Disability Rights and Service Animals

By Michael Kaplen

ADVERTISEMENTS

My partner, brain injury attorney, Shana De Caro has recently been selected to be a member of the Ask The Expert panel on BrainLine.

Her most recent post, Ask the Expert: What the Disability Laws Say About Service Dogs has recently been published on the BrainLine web site.

A reader with a brain injured child who was returning to school was seeking permission from the school district to allow the infant to be accompanied by a service dog.  Unfortunately, the school district refused to allow this reasonable accommodation.

Shana's answer carefully reviewed major federal laws dealing with disability protection including the Individuals With Disabilities Act (IDEA); Section 504 of the Rehabilitation Ac;t and the Americans With Disabilities Act (ADA) as well as special protections afforded under the New York State Humans Right Law.

Shana's answer sets forth a concise step by step process of applying for this type of disability benefit following a traumatic brain injury.

Shana is a noted brain injury attorney who is also an Officer of the Traumatic Brain Injury Litigation Group of the American Association for Justice. She practices with me in the New York Brain Injury Law Firm of De Caro & Kaplen, LLP and represents individuals with traumatic brain injury througout the nation.
