Lawsuit Stemming from Birth in Michigan Jail

By Oguz Ozdemir

ADVERTISEMENTS

About 10 years ago, Chelsie Barker, was born in a Michigan Jail after her mother went through a painful labor in her jail cell. It has been reported that Chelsie's mother, Chantrienes Barker, was not checked on for almost two hours, when the jail's officers clearly knew that Barker was expecting to be going into labor. It ha been reported that the fellow cell mates and those around Barker were trying to gain the guards attention to notify them that Barker was giving birth in her jail cell. Finally the guards came to aide in the situation but it was too late, the guards called the paramedics at 2:00am when then babies head was emerging. When the paramedics arrived the baby, Chelsea Barker was not breathing and was then rushed to the hospital. Chelsie Barker was deprived of oxygen for too long and sustained permanent brain damage. Chelsie will never be employable and will need 24/7 supervision. The defense claims that they were not liable under the 14th amendment that states, ' The government shall not deprive any person of life or liberty without due process.' In the monumental case Roe V Wade, it was decided that a fetus does not constitute being a person. Experts have stated that the use of Row V Wad has been used incorrectly here. If you or a loved one has been victimized by an act of birth injury, contact super lawyers at Napoli Bern Ripka, LLP as soon as possible.
