Diet or Regular? Missouri Supreme Court reverses Jackson County Circuit Court ruling that certified a plaintiff class against Coca-Cola . KC Business Journal. The Jackson county circuit court granted class status to plaintiffs who alleged that Coca-Cola deceptively marketed Diet Coke because fountain dispensed Diet Coke contained saccharine as well as aspartame. Missouri Supreme Court on an original writ of prohibition agrees with Coca Cola to prohibit the class action.State ex rel. The Coca-Cola Company, Relator, v. The Honorable W. Stephen Nixon, Respondent.: SC88531 "Because Pennington's proposed class definition cannot be amended without becoming indefinite and given the sizable number of uninjured putative class members, the class definition is impermissibly overbroad. The circuit court abused its discretion when it certified this class action. The Court's conclusion is consistent with the holdings of other courts that have addressed this issue."
