Posted on June 07, 2009
The short answer is yes you could. Florida has an indigenous problem with pet owners. Floridians have been dumping Burmese python snakes into the Everglades after they grow too big to be house pets. So much so, that their population is estimated to be moiré than 150,000 pythons now calling the Florida Everglades home...

Carradine Death: Grasshopper: Nothing is softer than water; yet water can wear down the hardest rock.

Posted on June 06, 2009
In the 1970's I watched Kung Fu and with each show was reintroduced to a quality of a good life that my mother had instilled in me. Today I am a lawyer and being a civil trial lawyer tests my faith in people to understand the tenets of a strong civil justice system...

Posted on June 04, 2009
The seminal event for water safety has to be the sinking of the Titanic. On April 14, 1912 the HMS Titanic struck an iceberg and sank taking with it 1,516 passengers and crew members. One of the 706 survivors was the 9-week-old infant Millvina Dean. Ms...

Posted on June 03, 2009

For the last week I've been posting on the Lombardi Law Firm web blog about pedestrian safety. A Google Alert came across my computer screen last Wednesday that is incredibly sad and for that reason I'm going to not mention any names of those involved...

Baby boomers cap damages with made in China cheer

Posted on June 02, 2009
I want to start out this blog with a song by Quynh Anh. She has a great voice but the message she sings is most appropriate for today's baby boomers. You should listen to it as you read today's blog, which is like a protest. I'll say this about the generation born after the mid 1970's, at least they have an excuse for not knowing what we stood for in the 1960's and 70's...

Dean of Law at Liberty University: Are you planning on condemning the murder of Dr. Tiller?

Posted on June 02, 2009
The murder of Dr. Tiller in Kansas is raising serious questions about those who sit quietly on the sidelines not condemning the act. The anti-abortion groups must condemn this murder if they are to have any legitimacy. To do otherwise shows the lawlessness of their motives...

With Tort Damages Reformed Who Wins And Who Loses?

Posted on May 30, 2009
Today is the end of May 2009 and I thought it appropriate to end Tort Reform month by focusing on the winners and losers when society artificially limits tort damages with caps. It's been fun this month writing about a topic that strikes so many as emotional...

PART 10 of 10: The economics of non-economic damages. What can Bernie Madoff teach us about the tort reform campaign?

Posted on May 29, 2009
This clip that follows is almost 34 minutes long and certainly too long for most people's attention. If you have an idea of what to listen for and look at it helps with watching and listening to the entire clip. May I suggest you watch Bernie Madoff and listen to the main speaker? They are very convincing, to people who like you who want to keep more money by saving money on those things you don't have time to understand...

Student Democrats at Liberty U. are okay; so long As they think like a Republican.

Posted on May 29, 2009
At Liberty University it's not about Floccinaucinihilipilification, but Antidisestablishmentarianism THINK LIKE US OR DON'T THINK AT ALL You're going to ask it so I'll tell you now. Liberty University is trying to do an about face after taking away the University endorsement of the student's Democrat Club...

Posted on May 28, 2009
This case may answer the question in Iowa: Once under control would repeated Tasering of a suspect be considered an abuse of police power? The Courts define what force is legitimate police power and when the use of force becomes punishment. It is the court's that mete out punishment sanctioned by state law; whereas police enforce the laws...

Posted on May 28, 2009
The lesson today has to do with facts or the lack thereof. First let's look at shaping the emotions of tort reform minded voters and then at why tort reform is creating a greater needs for personal injury trial lawyers. THE EMOTIONS OF HATRED Where are the facts underlying that the medical profession can not afford to pay Mr...

Posted on May 28, 2009
Yesterday we reported on a man dying from being thrown from his truck as it rounded a curve. The way the story was written it left me with the impression he was the driver. Today we have a report of a 61-year-old woman dying from being struck by a wind-swept door...

PART 8 of 10: The economics of non-economic damages. Never trust a trial lawyer. It's okay to hate liberal trial lawyers.

Posted on May 27, 2009
Now listen to the conclusions made in this film clip about communism, without any proof of the underlying premises. This is similar to the tactics tort reformists employ. It's all about emotions. The dusty attics and basements can be interchanged with courtrooms and lawsuits...

PART 7 of 10: The economics of non-economic damages. Are the emotions of fear and hate really necessary to sell economic reality?

Posted on May 26, 2009
In this film we see how people in power can misuse their power and who must pander to your emotions in order to get you to buy into their version of what the truth is. To pander to emotions it's necessary to employ illogical thinking and at the same time to make you believe that thinking is a bad thing...

Posted on May 25, 2009
A young lawyer fresh out of laws school arrives for his first interview. The expectations are sky high. He believes it went well and towards the end of the interview he gently asks, 'How much is the pay?' The trial lawyer knowing this newbie lawyer has no clients, never having argued a motion or tried a lawsuit looks straight into the young man's eyes and replies, 'How about if I pay you what you're worth?' Yesterday we listened to Texas Tort Reform propaganda and it should make you wonder where before you've heard similar proclamations by people in power or from those taking the most from society...
