Skadden, Arps Has a New Website
Posted on December 10, 2008I like the old one better.(Make your own link. It's finals and I'm busy.)EDIT: Here's a link just for you, Matt.----------------------------[Update (Patrick): Carbolic's tastes err -- the old site is much worse than new one, for the same cardinal reason that LEXIS is worse than WestLaw...
Corruption in Chicago? I don't believe it.
Posted on December 09, 2008It's the news of the hour. TV's most photogenic US Attorney, Patrick Fitzgerald, has arrested the governor of Illinois for, among other things, trying to "sell" the U.S. Senate seat vacated by (technically-not-yet)-President-Elect Barack Obama. (Actually, there's more to the indictment...
Good Idea?
Posted on December 08, 2008I have a secret confession to make. I love infomercials. I even love the not-quite-an-infomercial "As Seen On TV" product ads. The products that they put out there, especially during holiday times, are, for lack of a better word, absurd. Every year there's a product that makes me scratch my head and wonder, "There can't possibly be any people dumb enough to pay a nickel for this crap...
A Resolution of My Own
Posted on December 05, 2008If the Berkeley City Council thinks it knows what's best for Boalties, I figure so do I. But the proposal I have in mind is a lot less kooky, therefore, boring. Adam Chandler has this essay at Slate on cert stage amicus briefs. Orin Kerr thinks this might be a good idea for law school SCOTUS clinics...
Another Reason to be Thankful
Posted on December 05, 2008Today is the 75th anniversary of the repeal of the 18th Amendment. Here is a Time Magazine article from 1930, as the repeal effort was building. It is a hoot. Now, go out and celebrate!
Berkeley City Council Delves Back into National Politics
Posted on December 04, 2008The Marine Corps issue may have fizzled, but apparently the City of Berkeley's passion for national and foreign policy burns on.Next week the Berkeley City Council will vote on a resolution demanding the United States charge Boalt Professor John Yoo with war crimes...
More Prop 8 Re-hashing
Posted on December 04, 2008With all of the discussion about Prop 8 on N&B thus far, I figured at least a few of you may find this new study more than a little interesting.A commonly cited fact since the election is that black and Hispanic voters overwhelmingly supported Prop 8...
DE and Yudof to Crowd: We're Screwed
Posted on December 04, 2008Think your education is expensive, and yet the University may be in jeopardy? DE and UC President Yudof think you're right:Three of the state's leading higher education officials gathered Tuesday to elaborate on what they've known for months: Major financial woes face the University of California, and won't be leaving any time soon...
Straight From the Horse's Mouth: Fall 2008
Posted on December 03, 2008Here is your fall 2008 professor quotes thread. While perhaps not as thorough as last year, I have posted in the comments my collection of this semester's notable moments. If you have contributions, please share them. They tend to make my day.
(Re)calling ASUC Senator John Moghtader
Posted on December 03, 2008Five Boalties are attempting to initiate a recall of ASUC Senator John Moghtader. According to the Daily Cal, the recall follows an altercation in Eshleman Hall on Nov. 13 between pro-Palestinian and pro-Israeli students, after which three people were charged with battery...
San Francisco is Full of Degenerate Homeless Drug Addicts

Shameless Self-Advertisement
Posted on December 01, 2008Much like [insert reference to a famous electoral defeat, maybe LA Confidential against Titanic], Nuts & Boalts took a beating at the ballot box last year for the ABA's best blawgs. But the honor of being nominated was good enough. This year, Nuts & Boalts has been nominated again in the student blog category...
What's going on in Zeb?
Posted on December 01, 2008Reports of cops in the law school with their guns drawn?Anyone know what's going on?--Update: They're gone- even their cars. But what happened?
An Intriguing Take on Prop 8
Posted on December 01, 2008Just saw this in the Chronicle. It's an open letter, from two of Berkeley's own, asking the state for a non-discriminatory alternative to what they see as now-discriminatory marriage. Basically, they want domestic partnerships to be available to straight couples...
What the Heck are Emoluments?
Posted on December 01, 2008Hillary haters have latched on to the Emoluments Clause of the United States Constitution to argue that Senator Clinton, who Barack Obama just formally announced would be his Secretary of State, is constitutionally barred from taking the post. Here is a summary of the issue...
A Heretical Question
Posted on November 30, 2008One of my college professors liked to remark that, depending on which side of an argument you've taken, a conclusion can be characterized either a result or a reductio. Let's try one, from yesterday's NY Times:Because the war on terror is unlike any other the United States has waged, traditional wartime policies and mechanisms have made for an awkward fit, in some instances undermining efforts to defeat terrorism...
How I Learned to Litigate at the Movies
Posted on November 27, 2008Over the summer, the American Bar Association polled its members and then published in the ABA Journal a list of the twenty-five greatest legal movies of all time, and another twenty-five honorable mentions. The publication also included an article entitled, "How I Learned to Litigate at the Movies...
Do People Care About Students? People Do
Posted on November 25, 2008This from John Steele:If you have a moment, could you please answer this one-question survey about legal ethics courses? Choose as many courses as you?d seriously consider taking if you had those options for legal ethics credit. If you?re curious about the results, shoot [John Steele] an email in about a week and [he]?d be glad to share the percentages that came in...
Finals Racket
Posted on November 25, 2008Did anyone else find this particular tidbit from DE's email today amusing? The good news from this test is that the noise was only faint to moderate in the north addition reading rooms. Zeb and Goldberg were also surprisingly quiet. The noise was worst in the Main Reading Room, classrooms 121-124 and 115, 111, 107...
1L Hypo Exercise
Posted on November 24, 2008The facts are presented here. Use what you have learned in Contracts and Property to explain who should win this law suit and why. Does Porreco v. Porreco, 811 A.2d 566, 574 (Pa. 2002) (Eakin, J., dissenting) apply? Bonus points for Civ Pro and Crim Law arguments.
Lawyers Abroad
Posted on November 24, 2008This NY Times article, published Friday, describes an influx of U.S. legal résumés in foreign markets:A year ago, a lawyer looking for work in Hong Kong could have gone on eight interviews and had seven offers, [a legal recruiter] says. But in this market, firms can afford to be choosier...
Turkey Bowling
Posted on November 23, 2008Pushing aside the wet blanket over your personality that is law school can be wearisome. The fact is that this place, at this time of year, is a fun-killer.Enter turkey bowling. The game feels adventurous enough to limber your character as we enter the exam period, and the rules are simple enough to recall even when highly intoxicated...
Sorry Tom P., The Waiting Sucks, But It Is Not The Hardest Part
Posted on November 20, 2008A few rants about this whole bar exam process...There was a recent post regarding the MPRE being a harbinger of Bar anxiety. Well, look... The MPRE is the proverbial mole hill, and the Bar exam is...no, not a mountain, it is just a freakin' ass-h*le...
Good Luck, We're All Counting On You
Posted on November 19, 2008I know a lot of people in the Class of 2008 are going through hell. The next few days are absolute torture. For the uninitiated, think of it as that feeling in your stomach when a roller coaster drops...except it lasts for about a week. Bonne chance.
Breaking News: Cal. Supremes Take Prop. 8 Cases
Posted on November 19, 2008The California Supreme Court has agreed to take cases challenging Proposition 8. The Court also announced it will not stay the proposition pending a decision. (Sorry, Gavin.)The Court will address three questions: Is Prop 8 invalid because it constitutes a revision of, rather than an amendment to, the California Constitution? Does Prop 8 violate the separation-of-powers doctrine under the California Constitution? If Prop 8 is not unconstitutional, what is its effect, if any, on the marriages of same-sex couples performed before the adoption of Prop 8? Briefs are due in January, and oral argument may be held as early as March...
An Open Letter to Uncle Zeb
Posted on November 19, 2008Like the rest of the tenants of the 21st century, I rely on credit and debit cards as my primary method of legal tender. I recognize that carrying cash worked perfectly fine in the days before electricity and networking were readily accessible, but given the advances since, it seems silly to keep insisting on it...
Harvard Gets Caught in the Credit Crunch

When free speech isn't free speech
Posted on November 18, 2008The Mercury News reports today: "Nine people sentenced for involvement in UC Berkeley tree-sit."Hopefully this will be a lesson to the rest of Berkeley's crazies: defy court orders to protest a pointless cause and you will pay the price. It's not free speech if it's costing students millions of dollars while you throw your feces at our police officers.
A Bailout for Detroit?
Posted on November 18, 2008The lame duck Congress is currently considering whether to give automakers some of the bailout money - to the tune of ten billion dollars. Intense lobbying efforts are underway right now, with Detroit desperately trying to convince Congress that this bailout money is all it needs in order to become a viable business model again...
